Terms of Service

By accessing or using Gracious Sendoff (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Gracious Sendoff is operated by Vumi Studio, based in Nairobi, Kenya.

Gracious Sendoff is a digital memorial platform that allows users to create, customize, and share memorial pages for their loved ones. Memorial pages can include biographies, photo galleries, tributes from family and friends, event details, and other commemorative content.

To create a memorial, you must sign up for an account. You are responsible for:

• Providing accurate and current information.
• Maintaining the security of your account credentials.
• All activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these terms.

You are solely responsible for the content you upload to your memorial page, including text, photos, and other media. By creating a memorial, you confirm that:

• You have the right to share all content you upload.
• The content does not infringe on anyone else's rights.
• The information about the deceased is accurate to the best of your knowledge.

Gracious Sendoff offers two memorial plans:

• Standard Plan: $29 — memorial stays online for 1 month.
• Extended Plan: $49 — memorial stays online for 3 months.

Payments are processed securely through Stripe or Paystack. Once a memorial has been published and is live, payments are non-refundable. If you experience a technical issue that prevents your memorial from being created, please contact us for assistance.

You may not use Gracious Sendoff to publish content that:

• Contains hate speech, threats, or harassment.
• Is illegal or promotes illegal activity.
• Impersonates another person or misrepresents the deceased.
• Contains sexually explicit material.
• Infringes on copyrights, trademarks, or other intellectual property rights.
• Contains malware, spam, or deceptive content.

We reserve the right to remove any content that violates these guidelines and to terminate the associated account without refund.

You retain full ownership of the content you upload to Gracious Sendoff. By using the Service, you grant us a limited, non-exclusive license to display, store, and distribute your content solely for the purpose of operating the memorial page as you intended.

The Gracious Sendoff name, logo, and platform design are the property of Vumi Studio and may not be used without our written permission.

Gracious Sendoff is provided “as is” without warranties of any kind. While we strive to keep the platform available and your data secure, we cannot guarantee uninterrupted service. To the fullest extent permitted by law, Vumi Studio shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Our total liability to you for any claim related to the Service shall not exceed the amount you paid for your memorial plan.

Memorial pages are published for the duration of your chosen plan (1 month for Standard, 3 months for Extended). After the plan period ends, the memorial page will be taken down and will no longer be publicly accessible.

We will send you a reminder before your memorial expires. You may renew your memorial by purchasing a new plan before or after expiry. Content from expired memorials is retained for a reasonable period to allow for renewal.

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

If you wish to delete your account and all associated data, please contact us at support@vumistudio.com.

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Continued use of the Service after changes constitutes acceptance of the new terms.
